PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

We've provided this Privacy Notice to inform California residents about the categories of personal information collected by Swytchback, Inc. (“Swytchback,” “we,” “us,” or “our”) and the purposes for which it is used, as required under the California Consumer Privacy Act (“CCPA”).

What does Swytchback do?

Swytchback provides an online platform that allows the creation and deployment of online surveys and other types of customer feedback tools (collectively, “surveys”) by and for our customers (“creators”).  We then gather information generated by and from individuals who participate in those surveys (“respondents”) and share that information with creators so they can better understand the desires and concerns of their customers (collectively, the “Services”).  

Operation of our platform necessarily results in the collection of“ personal information,” which is defined in the CCPA broadly to include data that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household or device.

What categories of personal information are collected and for what purposes?

Below is a summary of the categories of personal information we may have collected from California consumers within the last twelve (12) months and the main purpose for its collection.  That personal information may have been sourced from creators and/or respondents.

  • Creator Personal Information: In order to establish accounts for creators, we need basic personal information about creators, namely their names, email addresses, payment information, and physical addresses for the purposes of establishing and maintaining accounts for them on our Services. We may also receive email addresses and other contact information from potential customers that contact us through our website at www.swytchback.com (the “Site”).
  • Creators’ Customer Data: Depending upon the relationship we’ve established with creators, we may receive personal information directly from them for the purposes they’ve directed, such as conducting surveys on their behalf with designated respondents.  In those cases, we are acting as a “service provider” within the context of the CCPA, and we have entered into agreements with creators to use that personal information for the specific purpose identified in those agreements.
  • Respondent Personal Information: When respondents interact with surveys, we may collect personal information from them, such as email address, device identifiers, cookie information and IP address, along with other non-personal information they submit as part of the survey.  That information is used for the purposes of conducting the surveys and reporting that information to creators.

Please remember that many of our surveys require that we collect personal information, so if you don't like that your personal information will be used for that purpose, please don’t participate in our surveys. By participating in surveys, you are expressly consenting to our use of your personal information for the purposes as set forth in this Privacy Notice and in our Privacy Policy.  

What are other uses of personal information?

As noted above, we use personal information to provide our Services described above.  In addition, we may use or disclose the personal information we collect for one or more of the following business purposes:

  • To fulfill or meet the reason for which the information is provided. For example, if you contact our customer support, we may use your email address to communicate with you about your support issue.
  • To provide you with information, products or services that you request from us.
  • To provide you with alerts and other notices concerning our products or Services.
  • To carry out our obligations and enforce our rights under the Swytchback Terms of Service.
  • For testing, research, analysis and product development to improve our Services.
  • To protect the rights, property or safety of us, our subscribers or others and to respond to legal requests.
  • As described to you when collecting your personal information or as otherwise set forth in the CCPA.
  • For the other purposes set forth in our Privacy Policy.

What categories of third parties does Swytchback engage?

To provide our Services, we also engage the assistance of third parties that we categories as follows: (i) “Back End Providers” provide the backend infrastructure necessary for the Services to function, such as hosting and internet access providers; (ii) “Fulfillment Providers” provide payment processing and messaging tools that we may use to fulfill an aspect of the Services, such as processing payments from creators; and (iii) “Service Providers” who prove provide ancillary services like website analytics and customer support platforms. We have entered into agreements Back End Providers, Fulfillment Providers and Service Providers that limit use of personal information for the specific purpose identified in those agreements.

What are my rights as a California resident?

The CCPA provides California residents with specific rights regarding their personal information, as described below.

Opt Out of the Sale of Personal Information

The CCPA requires that we notify you of your right to opt out of the sale of your personal information.  However, we don’t sell your personal information as contemplated under the CCPA, so there’s no need for you to opt out of the sale of your personal information.

Please remember that our surveys involve the collection of personal information from respondents on behalf of creators, which is then shared with those creators. If you don’t want any of your personal information shared in that manner, you must not participate as a respondent in our surveys.  

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Note that you may only make a verifiable consumer request for access or data portability twice within a12-month period. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • If we sold or disclosed your personal information for a business purpose:
  • The categories of personal information that we’ve sold about you and the categories of third parties to whom the personal information was sold.
  • The categories of personal information that we disclosed for a business purpose.

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions.

Please note that the CCPA includes a number of exceptions that allow us to retain your personal data despite your deletion request, so we may retain your personal data under those exceptions.
